Hoscote Estate - Terms and Conditions of Hire

The receipt of a signed booking form and initial payment by Hoscote Estate is treated as a firm booking and, if accepted, the Hirer becomes liable for the full balance of charges, which are payable six weeks prior to the commencement date of the holiday. Non-payment of the balance of hire charges by the due date will result in Hoscote Estate treating the property as being available for re-booking.

If the Hirer cancels a confirmed booking he/she remains liable for payment of the full cost of the holiday. Upon receipt of written confirmation of the cancellation from the Hirer, Hoscote Estate will endeavour to re-let the property and if successful will make a full refund to the Hirer less an administration fee of £55.00 (inclusive of VAT) and any other expenses incurred in re-letting.

The Hirer is responsible for the condition of the property and its entire contents during the hire period, fair wear and tear excepted. The Hirer will make good any damage or loss and leave the property and contents in clean and tidy condition. The estate reserves the right to deduct from the housekeeping deposit the cost of making good any damage or loss to the property or for excessive cleaning found necessary following the period of occupation or for any outstanding phone bills. The person held to be responsible for the hiring party will be the person who signed the booking form.

Hoscote Estate reserves the right to decline to hand over the property to any person or persons who in their opinion are not suitable to take charge. In such cases, hire charges shall be refunded in full and the liability of Hoscote Estate shall cease. If Hoscote Estate is prevented, because of circumstances out with it’s control, (e.g. fire damage, drought or the interruption of utility supplies), from putting the property at the disposal of the Hirer, the hire charge shall be refunded in full but the Hirer shall have no further claim against Hoscote Estate.

The Contract effected between the Hirer and Hoscote Estate is in terms of Schedule 4 Section 8 of the Housing (Scotland) Act 1988 and confers on the Hirer the right to occupy the property for the period agreed for holiday purposes only.

Hoscote Estate have taken every care to ensure the accuracy of property descriptions and all information is given in good faith and believed to be correct at the time of going to press, but they cannot be held responsible for changes beyond their control or be liable for any act, neglect or default on the part of the owner resulting in loss, injury or accident caused to the Hirer.

The Hirer shall not sub-let the premises or any part thereof.

The number of people occupying the premises shall not exceed 18 in Hoscote House, 4 in Gardeners Cottage and 6 in Pathhead Farmhouse and 5 in The Lodge.

The Hirer binds and obliges himself to vacate the hired premises without demand at the termination of the period of hire.

The Hirer shall undertake to prevent any member of his party from causing nuisance or disturbance to other residents or occupiers.

The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of the let.

The Hirer undertakes to relieve the Hoscote Estate from any liability for damage or injury however caused by any member of his party.

Hoscote Estate, their agents or employees, accept no responsibility for loss, injury or damage to any member of the Hirer’s party or their property, howsoever caused, arising in any manner out of the let of the premises.

Water Supply – The properties on Hoscote Estate are supplied by a private water supply. The water from the water supply is tested on a regular basis. If you feel at all uncomfortable you may prefer to boil water for drinking, or purchase bottled water.

Smoking – We would ask guests to refrain from smoking anywhere in the houses.

Pets – We welcome small well behaved dogs to Hoscote Estate, but would ask that they go no further than the kitchen areas, and would point out to owners that there are a considerable number of sheep grazing on the adjacent farmland and would ask that the dogs are kept under control at all times. Unfortunately we can’t accept dogs in The Lodge.

Septic Tank – As drainage is by means of a septic tank, we would ask that some consideration is given as to articles that are put down the w.c.s, and would ask particularly that you avoid nappies, sanitary towels etc.
